I have a client who was charged last night and due to attend Westminster MC this morning. I’ve just been informed that the van broke down, and he’ll now be kept in until Monday.

My understanding of PACE s. 46(2) is that they have no power to do this: ‘... in any event no later than the first sitting after he is charged with the offence’.  It appears to me that they have no power to hold him until Monday.

Would appreciate any advice!
