I am just wondering if anyone has ever had a successful appeal of police refusal to remove details from the PNC? A client of mine has had their appeal refused. He is seeking to remove the fact of his arrest from his record but the appeal was refused on the basis that there is no evidence the offence did not take place.

 

We are currently litigating against the police for wrongful arrest/unlawful detention but we are only in the initial stages and I am just wondering whether there is any merit in challenging the appeal refusal further at this stage. I was curious if anyone had had a successful appeal and on any grounds which are not that there was incontrovertible proof that the offence did not occur?
