I suspect hourly rates for Magistrates’ Court would lead to a decrease in income.

 

Those cases that need the extra effort, receive hourly rates anyway under the CRM7 escape mechanism and with a fixed fee the cases with the least work needed actually attract the highest hourly rates.

Can I say that I agree with you Richard.  I thought I was in a minority of one! It has been my view for a while that many of the interviews are unnecessary and proceed out of ignorance of PACE on the part of young inexperienced officers, from PCs to Inspectors!  Many arrests are made for the purpose of interview, not because the arresting officer had reasonable grounds to suspect that an offence HAD been committed!  They receive a spurious complaint and instead of probing and testing the complaint, they arrest to see what the DP might say to beef up the complaint.  No wonder the charging rate is 10% of arrests!  We go along with it for the fee so we say nothing about the many unlawful arrests we encounter.  Our clamour for increased rates etc has been ignored, (while the bar seems always to get a positive response), because we are not as well regarded by the powers that be, for precisely ceding the moral high ground in this way.  We should be arguing for no means testing across the board and hourly rates for magistrates’ court cases, so that the fewer cases that come through are properly remunerated and the serious lawyers properly paid.

I disagree with Neil

 

An interview will nearly always be in the interests of the Police. The Police are usually keen to interview.

 

In strong cases it will allow them to rule out any defences by going through possible defences in interview.

 

It sets up an adverse inference later if the suspect is charged and decides to give evidence at trial.

 

It can set up an adverse inference if the suspect answers questions and gives evidence at trial that ought to have been mentioned at interview.

 

The work will come through at Court if Police proceed to charge without interview.

In order to reduce exposure to Police stations, any suspect who has been arrested and can be released should be bailed to return in 3 months time for interview as of now.

 

These would be minor cases or cases where custodial sentence unlikely and cases where there is a settled address and no risk of absconding.
