We have attended one last week by way of telephone as suspect had been arrested whilst self-isolating.

Officers emailed disclosure, with instructions and interview conducted by phone.

After the interview, we notified the Contract Manager, gave full disclosure of what had happened and that we intended to make a full claim and trusted that this would not be an issue on audit….

CM has simply said that he would pass it on and the LAA would provide a FAQ…… that was last week and we have not heard back…

This is an easily foreseeable issue upon which the LAA should have made a decision/ruling and disseminated their decision. 

 

To leave defence lawyers in limbo and carrying 100% of the risk is unfair and unreasonable.

Be careful what you wish for. According to the LA contract, payment for police station will only become payable on attendance. If however, you do consultation by phone, then you cannot claim the fee. If you do this will go down as a fraudulent claim and will have to pay it back. Under such circumstances, only telephone advice fee can be claim.

 

Before doing anything the LA must become involve and alter the wording of the contract. So, be very careful about giving telephone advice and putting in a claim for police station attendance

Thank you for the clarification.  

This is a difficult time for all but I would ask everyone to have consideration for the freelancers amongst us who do not have the luxury of a salary to fall back on.  I fully endorse and support the decisions being made and appreciate they are being made to protect us all. 

The reality for freelancers, as you know, is that for a majority of us is that if we do not work we do not eat.  Therefore I appeal to all partners to ensure that outstanding payments are paid to the relevant Freelancers particularly at this time.

In a tel chat with my contract manager yesterday,  I set out my strategy for dealing with any police station work that comes, as consisting of dealing entirely on the phone.  She was completely sympathetic. Her only regret was that if the police refused to co-operate and I handed the case back to DSCC, there might be someone else who would accept the work.

 

Let us all refuse to attend in person and only deal with cases over the phone. See if the world explodes.

Our message to employees and freelancers is clear however.  You do not need to put yourself in danger by attending police stations and courts in person; it is not safe.  No one should require you to.
