Our contract manager has told us that if we “cannot attend in person” at a police station we have to return the case to a person who can.

Payment for attendances remotely are being looked into but currently “there is no change”.

My proposal in so far as signing Legal Aid forms is ( after getting verbal authority from the client to do so),   simply “ PP “ the signature and write COVID 19 in brackets afterwards.   It is simply impractical and ridiculous for it to be countersigned.

Surely the LAA should set aside their instruction that any criminal legal aid forms signed by a lawyer should be countersigned by a supervisor. 

 

If we are to keep apart from each other, how do we deliver the signed firm(s) to the supervisor for signature?

 

Surely a solicitor can be trusted in theses times/circumstances?

 

Alternatively/additionally, a defendant in custody need not sign the form, the defence solicitor can do so and the Bench could confirm/authorise the signature. Or even return the power to grant legal aid to Benches/legal advisors?

We have been in direct contact with those responsible for co-ordinating the London Magistrates’ Courts raising our ongoing concerns about the safety of solicitors and discussing methods of improving safety for all.

 

We are grateful for the proactive engagement from Stephen McAllister and his staff and we welcome the steps being outlined in the Update which follows below.

 

We encourage all practitioners to make good use of the new dedicated mailbox specifically set up for you to raise your Covid-19 related issues/concerns. It would be helpful if members could also report instances of where good practice is taking place, as well as raising concerns, so that this good practice can be shared between the individual Courts.

 

We are hopeful that in due course we will see similar proactive engagement from the Metropolitan Police but sadly, to date, we have seen no such direct engagement and we direct members to the joint Message from the LCCSA and the CLSA published yesterday evening.
