Thank you for information in relation to the AGM of the LCCSA.   We should thank those leaving for their services.

 

I wont be attending the AGM but none the less I am sure we all thank them.  This is not personal and is not aimed at any individual.

 

That doesn’t alter the fact that we are now facing a different situation than even 3 weeks ago in relation to custody suites.

 

Many are not that aware of the positions available to help or to influence policy.  I personally would like to be involved but would only be able to deal remotely whilst the pandemic continues. I would have to understand if that was not acceptable.

 

I have replied to all emails and so wont repeat myself here save to say we are at risk in the custody suites in a way that does not exist anywhere else  except in hospitals. Where major precautions are taken to ensure safety.

 

We need to know what is being experienced and where it is happening and to protect solicitors and representatives doing a thankless job at the best of times.

 

There is little point in blaming anyone except the police who are imposing this and that is what we need to focus upon.

 

It is my understanding that all positions are likely to be filled now in any event as you indicate we have a new chairman. Most will not be aware of this until it is announced.

 

It is  pointless to blame people who are at the end of their period and that is not what I am doing.

 

I am asking solicitors to report what is happening with a view to moving forward.

 

The police have agreed to a protocol that will not protect us if the rates continue to rise etc.. Unfortunately it has to be accepted that suspects in police stations, tend to be the type of person whose lifestyle ensures that they will tend to not take up the offer of vacines, that are likely to be exposed to many illnesses especially those who have mental health problems and youths.

 

The issue is the dangers posed by consultation rooms; being small and unventilated and the lack of lateral flow tests at police stations.

 

This is not a discussion as to who is to blame; or who has let us down.

 

That is a pointless exercise and arises out of frustration as to what is happening now.

 

My fear is that nothing will be done now as this government will do nothing in the wider society until it is too late.  They are urging us all to take care  and so that is what I attempting to do.

 

Anyone watching the news can see what is happening.  The protocol really needs to be reimposed in its original form before someone dies.

 

Please don’t be side tracked but please do report any insidences or issues experienced at Custody suites.

Absolutely everything you say in this email and one a week or to ago is spot on

 

My personal experience over the past 10 days has been nothing short of shocking having attended custody suites for the first time in 16 months

 

Custody staff in 3 suites I have attended fail to wear masks, do not observe social distancing, there is absolutely no sanitisation going on ( let alone the enhanced agreed in the Protocol ) and in a similar vein ventilation of consult and interviewee rooms is non-existent

 

It follows that the agreed protocol being a unilateral agreement is being completely ignored by the Met It follows as a matter of law that the protocol has in my view, no standing given it is endorsed by the PNCC as part of the agreement

 

Sadly the LCCSA has let us down and in my view no solicitor or AR can be compelled to attend at risk of non payment in light of the above

 

To the shame of this profession at Leyton last Saturday Adnan “ a la carte “ Malik and myself were the only defence reps wearing a mask. I remain speechless at the brainless arrogance and ignorance of some who are supposed to be on our side

Dear All,

Call for reintroduction of remote interviews to be widened in light of this rising rate of infections, those in hospital and those dying.

First may I state this is not a call for the use of Remote interviews replacing face to face physical attendance, it is a call for common sense; in light of what we have seen over recent weeks.

The government has today announced that at this stage they are watching the figures carefully. The health secretary is predicting there might be 100,000 new cases per day during the winter. They do not intend to do anything to help stop this at this stage.

I am sure we are all following developments in relation to this.

Even the government is advising individuals to take care, get boosters etc., were masks to protect each other. That will not cut it in the police station due to the rooms being totally unventilated.

I think the protocol at police stations needs to be readdressed now as the consultation rooms/interview rooms are the last place anyone wants to be. In a small to tiny room , breathing the same air as the suspect and vice versa for usually at least an hour and then an interview in an equally tiny room with Perspex between you and police but nothing between you and client.

In reality this is dangerous for all involved. The Perspex cannot protect people breathing the same air for 30 mins, 40mins.

Despite rising rates of infection since the 19th July 2021 so called,’ freedom day’, the police have pushed for attendances to be the norm; the go to. They have achieved this despite rising rates of infection, hospitalisation and death, week on week.

The UK has the highest rate of infection and death caused by this pandemic due to the wait until it’s too late and there is nothing else to do attitude before we do something.

Why do we not use sense and protect ourselves from this pandemic until it is safe to relax the precautions.

At the time the initial relaxations occurred I accept we could not envisage what would be happening now, rates were reducing but that has completely reversed.

It is almost as if the government has decided that this pandemic should be over and so we will ignore anything to the contrary and just carry on. Money is the issue now but I am not talking about being payed to be furloughed I am suggesting that this is the only way we can safely carry on assisting clients who have been arrested.

This is why this pandemic has dragged on. If anyone who could, took precautions now we might avoid all out lockdown later. Nobody wants that and I fear no one could bear this.

It’s up to us. Do we put up and shut up until someone dies or do we demand that the protocol is readdressed in light of what we are now experiencing.

It’s up to us, you and I. I believe it should be reversed but this will not happen unless we all feel this way.

Maybe people could share on here what they are experiencing, has anyone become unwell what is happening.
