Thank you for forwarding a copy of this but in relation to police stations I don’t agree that we should revert to protocal 3 as that was introduced as the economy re opened. In fact we should be operating on the protocal before this as plan b is to work from home where possible and protocal 3  introduced in person attendance for all youths and those requiring AA.

 

Protocal 3 was when the rates of death and infection where lowering not increasing and not with the new variant.

 

The economy was opening up and there was not the requirement to work from home that is required by plan B to try and slow or stop the spread of the Omnicron variant.

 

Please note that whatever the protocal is we do not need to attend police stations to do our job; fulfil our role and therefore as the technology is in place to allow remote interviews that is what we should do until the government moves the economy away from Plan b.

 

Many of our clients are in fact youths and require an AA and so a move to protocal 3 is just not sufficient to safeguard your members and other solicitors.

Plan B

 
Following on from yesterday’s announcement made by the Government the Association is proposing the following be implemented:
  

1. We should revert to the default position as set out by the Lord Chief Justice in January of this year. “The significant increase in the incidence of COVID-19 coupled with the increase in rates of transmission makes it all the more important that footfall in our courts is kept to a minimum. No participant in legal proceedings should be required by a judge or magistrate to attend court unless it is necessary in the interests of justice. Facilitating remote attendance of all or some of those involved in hearings is the default position in all jurisdictions, whether backed by regulations or not”.

2. In relation to attendance at Police stations we should revert to version 3 of the Joint Interim Interview Protocol between the National Police Chiefs Council, Crown Prosecution Service, Law Society, the Criminal Law Solicitors’ Association and the London Criminal Courts Solicitors’ Association.
 
3. The defence to be given equal access to CVP suites in Prison in line with agencies such as HMCTS and Probation. New Video booths be brought into service inside Prisons as there is an abundance of suites within the Prison estate.
