Case 1 – Category 1EW (GCC 10.92) unless the transfer was because the Solicitor with conduct changed firms in which case nothing.
Case 2 – Not enough information. First was case fully prepared for trial? If so, CAT2 if it pays better than CAT1 (it often doesn’t if CAT 1 is HSF). If not fully prepared, depends on whether you
had legal aid extended to the new offence to trigger CAT2 mixed pleas.

Subject: Billing queries
Dear colleagues
Can anyone help me with the following two billing queries:
Case 1
Client pleaded not guilty at the magistrates court. We attended four hearings for him and took instructions on not guilty pleas. He transferred solicitors 1 week before the trial. Do we bill
it as category 1 EW or category 2 as we were trial ready?
Case 2
Client pleaded not guilty to burglary at the magistrates court and the matter was listed for trial. On the day of the trial CPS offered him an alternative charge of theft and he pleaded guilty
to theft. Does it get billed as category 1 or 2?
Any help is greatly appreciated.
