Threaten a writ of habeas corpus. 

That tends to gets them moving.

Surprisingly easy to organise at the RCJ too. I have done them in the evening!

Hi all,

 

Is there any formal governance of how long a prison / the OMU can perform checks on a prisoner before releasing them? At what point does it become an actionable unlawful imprisonment?  I had someone sentenced yesterday to a term long since served on remand, even the licence portion has been passed.

 

We are all familiar with our clients being detained for several hours before they are cleared for release but I have someone who has been waiting around 20 hours now. I’ve written to the OMU for an explanation.

 

Any help appreciated.
