Good afternoon Hilda

I just saw your email through the LCCSA about the sending fee. 

I don’t know if this helps, but I recently had a case where the clerk in the Magistrates Court mistakenly recorded that the client elected a Crown Court trial when in fact jurisdiction was declined.

The LAA would only accept the court record in terms of billing.  I contacted the Prosecutor who provided me with their record of the hearing and then contacted the court with all the information asking them to rectify their mistake.

It did take a long time, as the court took forever to deal with my query, but they eventually corrected the court record and provided me with the corrected sending extract.  I have only just provided it to the LAA, but our costs draftsman thinks that the correct payment will now be made.

Maybe you could contact the court to provide you with a completed extract?
