S28 recorded cross-examination: what you need to know:-
‘Section 28’ refers to the pre-recording of the cross-examination of certain witnesses in criminal trials. The recently announced roll-out of this final ‘special measure’ for vulnerable and intimidated witnesses, enacted in s 28 of the Youth Justice and Criminal Evidence Act 1999, follows the piloting of the measure for young witnesses in several Crown Courts, including Liverpool. HHJ Aubrey will share his experience of the pilot in Liverpool Crown Court, considering how the procedure works in practice.
