Could I please ask for your assistance in sharing with the Defence Community that Harrow and Isleworth CC will be piloting the attached forms from 10th September 2018. This will only be for cases originating at Ealing, Uxbridge and Willesden Magistrate’s Courts.

 

There are amendments to CrimPR 34 to be in force from 1st October 2018.  These direct the provision of better information by the appellant and response from the respondent all aimed at allowing the Crown Court to give directions and list an appeal hearing that will be effective without needing to have a hearing solely to list the matter and give directions.  The new rules are supported by a new notice of appeal and a respondent’s notice to be completed by the prosecutor within 21 days of the notice of appeal.

 

Where the Crown Court receives an “old” form from defence solicitors we anticipate the Crown Court will send an electronic copy to the solicitor with a request to complete in order to avoid the need for a directions hearing.  Where an “old” form is received from an appellant in person then a paper copy may be sent out to see if we can avoid a directions hearing

 

Appellants who need to use the “easy read” form currently available may continue to do so and the Crown Court will assume that they are not able to provide more case management information but the CPS will still respond using the new response form.
