You need first to consult your indemnity insurer and the SRA as to whether you are insured and/or professionally competent to deal. You obviously can not deal under your legal aid contract which relates solely to the law of England and Wales.

This is a jurisdiction in which you are not qualified. You may as well be asking about Peruvian law.

There is no adverse inference in Scotland, hence I would assume the reduced need to provide disclosure. The defence obtain their own witness statements from prosecution witnesses through precognisance agents and the rights to disclosure during court proceedings are historically extremely limited although the Human Rights Act seemed to improve things. You were not entitled to legal advice at all until the Human Rights Act and even now it is limited by solicitor's unwillingness to attend interviews rather than merely advise no comment over the telephone. This is a unique jurisdiction as far as corroboration requirements, hence the extreme caution saying anything.

Dear members

Has anyone any experience/tips of dealing with a Scottish matter being interviewed by met ( on their behalf ) with little to no disclosure as apparently is the norm in Scotland?
