Can 15 year old be arrested for child abduction of (willing) 14 year old girlfriend?
Harvey Fox 26 Feb 2018 19:19 GMT
I can see how his age has any relevance to whether he can have committed the offence.
The consent of the child is irrelevant.
I suppose the only issue is whether she has been removed from the lawful control of her parent/guardian, which depends on whether it is an authorised activity.
There may be public interest considerations but the arrest is perfectly lawful.

Subject: Can 15 year old be arrested for child abduction of (willing) 14 year old girlfriend?
Hi
My 15 year old client is here, in custody at Brixton, for child abduction, regarding his 14 year old (pregnant) girlfriend, at his flat when police came calling re FTA at court.
He has been arrested for child abduction. I'm arguing unlawful arrest/it is not child abduction.
Her parents do not want them to be together.
Any thoughts please?
Thanks
