Filtering takes place after six years but this offence does not qualify for two reasons:

1. Offences of harm to children are generally excluded and
2. S1 Children and Young Persons Act 1933 is specifically excluded from filtering under  The Police Act 1997 (Criminal Record Certificates: Relevant Matters) (Amendment) (England and Wales) Order 2013.

Dear All

I have a potential client she received a simple caution on the 18/07/2012, and
the allegation against her were Assault / ill-treat / neglect / abandon  a
child / young person to cause unnecessary suffering / injury  CONTRARY TO
SECTION 1 (1) OF THE CHILDREN AND YOUNG PERSONS ACT 1933. H.O. 11/3 Local none.

It is now over five years since she signed this simple caution, can somebody
out there clarify whether an application can be made to remove the simple
caution from her records or it can not be removed.

I await for your urgent assistance.
