Dear Members

I have a potential client charged with the above, in conference he confirmed of
having informed the police that he is diabetic type 2 and suffers from high
blood pressure and on that basis he could not provide a sample.

I don't think he complied with the road traffic act, what other defence he
ought to have come up to assist him for his failure to provide a sample, its
kind of strange why the police did not take his sample of breath but decided to
request for his blood sample.

Any views and assistance will be appreciated.
